Public opportunity to speak on any matter of public interest within the Board’s jurisdiction including items on the Board’s agenda, except for those items specifically scheduled as public hearings (see information below regarding public hearing public comments) will be taken at the beginning of the Board Meeting during the public comment period. In order that interested parties have an opportunity to speak, any person addressing the Board will be limited to a maximum of three (3) minutes.

CLOSED SESSION: This is the portion of the meeting conducted in private without the attendance of the public or press to discuss certain confidential matters specifically permitted by the Brown Act. The public will be provided an opportunity to comment on any matter to be considered in closed session prior to the Board adjourning into the closed session.

RECOMMENDATION:

1) Introduce the proposed ordinance entitled "An Ordinance Amending Title 9, Chapter 9.48, Section 9.48.030 of the Merced County Code Changing Fees Charged for Mental Health and Alcohol and Drug Services", and waive further reading; 

2) Open Public Hearing and accept public comment;  

3) Close the Public Hearing; and

4) Adopt said ordinance.

 

 

 

 

1:30 PM - EXECUTIVE OFFICE - REDISTRICTING PUBLIC HEARING 

Presentation by the County's demographic consultant on the redistricting process and public hearing to receive public input and testimony regarding Merced County's supervisorial district boundaries and communities of interest per California Elections Code Section 21500 et seq.

RECOMMENDATION:

1) Open public hearing, hear presentation on redistricting process including public submissions for communities of interest, and accept public comment; and 

2) Close public hearing; and

3) Provide guidance regarding communities of interest.

6.        Find that substantial evidence demonstrates that an emergency continues to exist regarding the HVAC systems at the Los Banos Spring Fair-Germino Building, 403 F St., Los Banos, such that the emergency will not permit a delay resulting from a competitive solicitation for bids, and the action is necessary to respond to the emergency. (4/5 Vote Required)

7.        Find that substantial evidence demonstrates that an emergency continues to exist regarding the access control system at seven (7) different Sheriff locations such that the emergency will not permit a delay resulting from a competitive solicitation for bids, and the action is necessary to respond to the emergency. (4/5 Vote Required)

8.        Find that substantial evidence demonstrates that an emergency continues to exist regarding the drinking water well at the John Latorraca Correctional Center (JLCC) such that the emergency will not permit a delay resulting from a competitive solicitation for bids, and the action is necessary to respond to the emergency. (4/5 Vote Required)

9.        1) Find that the Franklin-Beachwood Park project is categorically exempt under CEQA Guidelines Section 15303 (New Construction of Small Structures) and requires no further environmental Review under CEQA Guidelines Section 15183 (Projects consistent with General Plan or Zoning); 2) Approve the Conceptual Plan for future Franklin-Beachwood Park; and 3) Direct the Director of Public Works to return to the Board of Supervisors with the grant application results and to accept award.

BEHAVIORAL HEALTH AND RECOVERY SERVICES

10.     Approve Contract with Iris Telehealth, Inc. for the provision of Tele-Psychiatry Services.

11.     Approve retroactive Contract with U.S. Department of Housing and Urban Development for 2021 Continuum of Care Program for Project Home Start; and direct staff to return to the Board for any subsequent approval related actions necessary for implementation of the grant project.

12.     Approve retroactive Contract with U.S. Department of Housing and Urban Development for 2021 Continuum of Care Program for Project Hope Westside; and direct staff to return to the Board for any subsequent approval related actions necessary for implementation of the grant project.

13.     Approve Memorandum of Understanding with Memorial Hospital Los Banos to provide timely intervention and maximum available assistance for 5150/5585 evaluations of patients receiving care.

HUMAN SERVICES AGENCY

14.     Approve Contract with the California Department of Housing and Community Development (HCD) to accept Permanent Local Housing Allocation program funds.

15.     1) Adopt a resolution to authorize and direct to transmit the County of Merced’s Emergency Rental Assistance Round 2 federal allocation in the amount of $9,039,405.84 to the State Department of Housing and Community Development and authorize the Board Chair upon review by the County Executive Office, County Counsel, Risk Management, and Auditor-Controller to execute the agreement with the State to administer the County of Merced’s direct allocation and proportional State share for and on behalf of Merced County residents; and 2) Adopt a resolution to authorize and direct to transmit the County of Merced’s Emergency Rental Assistance Round 1 remaining federal allocation in an amount not-to-exceed $5,800,000 to the State Department of Housing and Community Development and authorize the Board Chair upon review by the County Executive Office, County Counsel, Risk Management, and Auditor-Controller to execute the agreement with the State to administer the County of Merced’s remaining direct allocation and proportional State share for and on behalf of Merced County residents.

16.     Approve Amendment to Contract No. 2021026 with Central Valley Opportunity Center to modify the scope of work, term, and contract amount for the operation of the Emergency Rental Assistance 1 Program.

PROBATION

17.     Adopt a Resolution reaffirming the creation of the Merced County Juvenile Justice Coordinating Council (JJCC), ratifying the creation of the subcommittee of the Merced County JJCC, adopting bylaws for the Merced County JJCC, and appointing specified persons to serve as members of the Merced County JJCC and its subcommittee.

ELECTIONS

18.     Adopt the Resolution to call for the California Gubernatorial Recall Election on September 14, 2021; and authorize the Elections Division of the Merced County Registrar of Voters to procure and furnish those election services requested by the State of California as set forth in their proclamation dated July 1, 2021.

RETIREMENT

19.     1) Establish the job classification of Retirement Investment Officer, classification 7894, salary range 86.8, and add one (1) Retirement Investment Officer to Budget Unit 76600; 2) Approve the addition to two (2) Staff Services Analyst I/II, class 1050/1040, salary range 70.2/74.6, to Budget Unit 76600; and 3) Approve the amendments to the Position Allocation Resolution 06-120A and Salary Allocation Resolution 06-120.

SHERIFF

20.     Approve and authorize the Sheriff to purchase asset number 81322, a Polaris Ranger ATV, before the final budget approval on September 21, 2021.

ADMINISTRATIVE SERVICES

21.     Declare assorted motor vehicles (listed on Exhibit A) as Surplus Property as recommended.

COUNTY COUNSEL

22.     Adopt resolution to amend Resolution No. 2016-05 at Section 2, to decrease the membership of the Le Grand Municipal Advisory Council from nine (9) members to seven (7) members, and at Section 4, to define the staggered terms in such a manner to reflect the decreased membership totals.

EXECUTIVE OFFICE

23.     1) Provide guidance to staff regarding the funding framework of the Coronavirus State and Local Fiscal Recovery Funds included in the American Rescue Plan Act, and 2) Approve a budget transfer in the amount of $537,665 for the recoupment of Fiscal Year 2020-21 ARPA eligible expenses. (4/5 Vote Required)

24.     Reappoint Bill Spriggs and Grey Roberts to serve as members of the Assessment Appeals Board, until September 6, 2024.

25.     Reappoint William Hass to serve as a member of the Hilmar Municipal Advisory Council, until May 3, 2025.

26.     Reappoint Bart Ramirez until December 7, 2023 and Stephanie Marchini until December 7, 2024; and appoint David Iniguez until December 7, 2024 to serve as members of the Le Grand Municipal Advisory Council.
