Important Notice Regarding COVID-19

 

Based on guidance from the California Department of Public Health and the California Governor’s Office, in order to minimize the spread of the COVID 19 virus, the Board Chambers will have limited public seating during the Merced County Board of Supervisors meetings. The County will conduct business in compliance with social distancing requirements with seating for the public limited to 25.  The County will also provide some overflow space on a first come first served basis.

 

The following alternatives are available to members of the public to watch these meetings:

PUBLIC COMMENT PERIOD: Public opportunity to speak on any matter of public interest within the Board’s jurisdiction including items on the Board’s agenda, except for those items specifically scheduled as public hearings (testimony limited to three (3) minutes per person).

 

All comments for items on the agenda other than those scheduled as public hearings will be taken at the beginning of the Board Meeting during the public comment period. In order that interested parties have an opportunity to speak, any person addressing the Board will be limited to a maximum of three (3) minutes. Please raise your hand when requested and you will be directed to the podium.  Please note that in order to maintain social distancing only one person may speak at a time, at the podium

 

PUBLIC COMMENT (Voicemail): You may also submit a general public comment for items not on the day’s agenda or comment on an agenda item via voice message by calling 209-385-7319.  All voicemails received prior to 9:00 am on the day of the meeting will be played during the meeting, as time allows.  Voicemails will be limited to three minutes in length.  Please submit one comment per voicemail and if commenting on an agenda item, please identify the agenda item number in your voicemail.  If you wish to do so, please identify yourself in your voicemail.  Phone numbers will not be made part of the record of the meeting.

 

PUBLIC COMMENT (Email): Email public comments will not be read during the meeting, but will be delivered to the Board of Supervisors prior to the meeting if received by 5:00pm on the Monday prior to the Board meeting. The Agenda is divided into three sections:

     •     CONSENT CALENDAR: These matters include routine financial and administrative action and usually are approved by a single vote.

     •     SCHEDULED ITEMS: These items are noticed hearings, work sessions and public hearings.

     •     REGULAR CALENDAR: These items include significant policy and administrative actions. Immediately after approval of the CONSENT CALENDAR, if the time of the hearing of SCHEDULED ITEMS has not arrived, the REGULAR CALENDAR will be considered.

CLOSED SESSION: This is the portion of the meeting conducted in private without the attendance of the public or press to discuss certain confidential matters specifically permitted by the Brown Act. The public will be provided an opportunity to comment on any matter to be considered in closed session prior to the Board adjourning into the closed session.

RECOMMENDATION:

3) Adopt the Resolution authorizing the General Vacation of Hatfield Road in the Stevinson area, from north of River Road to the end, which the Community and Economic Development Department has determined is exempt from CEQA under section 15301, subdivision (c), of the CEQA guidelines; and,

4) Direct the Clerk of the Board to record the Resolution

COMMUNITY AND ECONOMIC DEVELOPMENT - SECOND READING - PROPOSED ORDINANCE

Second Reading and Possible Adoption for a Proposed Ordinance amending Merced County Code Chapter 9.08 (Illegal Dumping on Public and Private Premises) and Chapter 9.70 (Public Nuisance Abatement)

RECOMMENDATION:

1) Conduct second reading of the ordinance entitled "An Ordinance Relating to Illegal Dumping on Public and Private Premises and Amending the Imposition of Administrative Penalties in Connection with the Maintenance of a Public Nuisance, Establishing Violation Categories and Increasing Potential Penalty Amounts" (Amending Chapters 9.08 and 9.70 of the County Code);

2) Waive further reading of the proposed ordinance; and,

3) Adopt the proposed ordinance

FIRE - SECOND READING - PROPOSED ORDINANCE

Second reading and Possible Adoption for a Proposed Ordinance amending sections 9.24.055 of Chapter 9.24, Title 9, and Section 16.30.020, Chapter 16.30, Title 16 of the Merced County Code

RECOMMENDATION:

1) Conduct second reading of an Ordinance entitled "An Ordinance relating to amendments to the Merced County Fire Prevention Ordinance and the California Fire Code," amending section 9.24.055 of Chapter 9.24, Title 9, and section 16.30.020, Chapter 16.30, Title 16, of the Merced County Code;

2) Waive further reading of the proposed ordinance; and,

3) Adopt the proposed ordinance

Public Works

1.        Approve Budget Transfer in the amount of $80,530 to reduce the Winton Station Remodel asset and associated Operating Transfer In to allow the Fire Department to reallocate the project savings to another account for use towards equipment for the new training site.

Human Services Agency

2.        Approve and authorize the Chairman to sign Amendment to Contract No. 2020127 with Taher, Inc. to provide cold meals for individuals who qualify and are served by Project Room Key.

Community and Economic Development

3.        Approve and authorize the Chairman to sign Amendment to Contract No. 2019052 with Tully and Young Inc. for professional special services in connection to sustainable groundwater planning in Merced County.

Executive Office

4.        Act on Claims for Damages submitted by Keith William Trout and George W. Scoggins as recommended by Risk Management and County Counsel.

5.        Approve and authorize the Chairman to sign Amendment to Contract No. 2020159 with Central Valley Opportunity Center for COVID-19 Outreach and Education to Farmworkers amending categorical not-to-exceed amounts to reflect actual operational costs.

PUBLIC WORKS

7.        1) Approve the Memorandum of Understanding between Merced County Department of Public Works and Merced County Department of Public Health establishing the terms and conditions under which reimbursements will be made relating to the non-infrastructure portion of the Delhi Active Transportation Grant Project; 2) Authorize the Chairman to sign the Memorandum of Understanding; and, 3) Approve associated budget transfers. (4/5 Vote Required)

LIBRARY

8.        1) Accept the allocation in the amount of $100,000 from First 5 Merced County for Innovation Grant Award to provide Ready for Kinder Merced County learning kits; 2) Authorize the Chairman to sign the contract; and, 3) Approve the related budget transfers. (4/5 Vote Required)

HUMAN SERVICES AGENCY

9.        1) Approve and authorize the Chairman to sign Amendment (Administrative Services Contract No. 13154) with the Valley Caregiver Resource Center for caregiving support networks for family caregivers and grandparents and older individuals who are relative caregivers.

10.     1) Ratify acceptance of the federal funding for the Emergency Rental Assistance (ERA) program in the amount of $8,255,908;  2) Approve and authorize the Chairman to sign a contract with Central Valley Opportunity Center for operation of the Emergency Rental Assistance program in a not-to-exceed amount of $8,055,908, for a term of February 9, 2021 through April 1, 2022;  3) Authorize the County Executive Officer authority to make changes to the contract scope of work based on additional guidance provided by the U.S. Department of the Treasury, upon review by County Counsel and Risk; and,   4) Approve related budget transfer. (4/5 Vote Required)
